Overview

  • Mid-Level Associate (Lawyer), Health Care, based in Boston, Massachusetts.
  • Advise health care clients (hospitals, academic medical centers, corporations, private equity, venture capital) on regulatory compliance, fraud and abuse matters, including HIPAA, Anti-Kickback Statute, Stark Law, state corporate practice of medicine, and the Sunshine Act.
  • Support clients in enforcement actions, including HHS OIG, state Attorney General, and Department of Justice investigations.
  • Draft agreements for buy-side and sell-side transactions, such as mergers, stock and asset acquisitions/sales, and joint ventures.
  • Lead due diligence efforts, coordinate with clients and outside counsel, and manage deal calls for health care transactions.
  • Provide legal advice on telehealth/telemedicine laws, and reimbursement/coverage rules under Medicare, Medicaid, the 340B program, and the Veterans Health Care Act.
  • Advise on government pricing, price reporting compliance, and the impact of federal and state legislation on pharmaceutical companies regarding market access, pricing, reimbursement, and drug price transparency.
  • Supervise and train junior Health Care associates.
  • Juris Doctor (JD) degree, Master of Laws (LLM), or foreign equivalent is required.
  • Requires at least three years of legal experience in health care transactions and investigations, specifically including drafting regulatory representations/warranties, coordinating due diligence for purchasers, and working on various corporate transactions for health care clients.
  • Extensive experience providing risk assessments and guidance on complex health care regulatory rules, Medicare/Medicaid, value-based care, risk-based organizations, insurance, government reimbursement programs, telehealth/telemedicine laws, corporate practice/fee splitting, and HIPAA Privacy/Security compliance (or Office for Civil Rights enforcement).
  • Minimum two years coordinating teams for corporate transactions and regulatory investigations.
  • Must be a member of the Massachusetts State Bar.
  • The anticipated starting salary range for this position is $310,000 - $365,000 per year.
